Court of Protection

If you are a Deputy or Attorney looking after the money or property of an incapacitated person, we can help you deal with the Court of Protection.  This is a specialist court for all issues relating to people who lack capacity to make specific decisions.

Our services include:

  • making applications for the appointment of Attorneys and Deputies
  • applying to the Court of Protection for permission to make gifts, trusts or Wills for the incapacitated person
  • dealing with disputes arising out of the operation of Enduring or Lasting Powers of Attorney or Deputyships

We have recently helped:

  • a Deputy apply to create a disabled person’s trust on behalf of a husband and wife, both of whom were incapacitated
  • an Attorney to apply for permission to make a Will for an incapacitated person where the application was opposed by a family member
  • an Attorney apply to make a Deed of Variation to achieve an inheritance tax saving
